PIL seeking apt utilization of the Indian Community Welfare Fund for bringing back expats

Pravasi Legal Cell in view of the order of Hon’ble Supreme Court dated 19-06- 2020 submits a representation to the Ministry of External Affairs for apt utilization of ICWF for repatriating Indians stranded abroad.

 

Pravasi Legal Cell(PLC) considering the plight of millions of Indian expatriates who are undergoing severe financial crunch due to the drastic effects of COVID-19 pandemic, had filed a PIL titled as Pravasi Legal Cell v Union of India & Ors.(Dy. No. 558/2020) before the Hon’ble Supreme Court through its Global President Adv. Jose Abraham. 

The above named PIL seeking apt utilization of the Indian Community Welfare Fund (ICWF) for bringing back stranded financially weak Indian expatriates was listed for hearing yesterday i.e. 19th June, 2020. The Bench comprising of Hon’ble Mr. Justice Ashok Bhushan, Hon’ble Mr. Justice Sanjay Kishan Kaul and Hon’ble Mr. Justice M.R. Shah disposed of the matter after appreciating the submission of Ld. Solicitor General that issue of the PIL is a matter of policy. His further submission that if the petitioner makes a representation to the Government, the same shall be considered by the Government in accordance with law, was also recorded in the aforementioned order. 

In view of the above submission made by the Ld. S.G. Sh. Tushar Mehta and the liberty granted by the Hon’ble Supreme Court, PLC submitted a representation today to the Ministry of External Affairs (MEA), requesting to pass direction to the embassies to utilise ICW fund for repatriating the Indian expatriates who cannot afford the travel expenses. 

The organisation in the instant representation has also requested the .MEA to consider the plight of the economically weak Indian expatriates. The representation also mentions that the current situation demands that the benefits of the directions passed by the Hon’ble Supreme Court to alleviate the sufferings of migrant labourers within the country in the Suo Motu case In Re:- Problems & Miseries of Migrant Labourers must be extended to the economically weak Indian expatriates as well. 

PLC herein also vehemently states, that it will continue to explore all remedies for realisation of this plea to utilize the ICWF for repatriating the deserving economically weak expatriates. Pravasi Legal Cell Kuwait Country head Mr. Babu Francis and General Secretary Mr. Biju Stephen, said the expatriate community is hoping that the central government will intervene to repatriate the poor expatriates using the Indian Community Welfare Fund.
